GTC
1. scope:
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded (hereinafter referred to as "order") via the shop or online shop of unlimited options GmbH (hereinafter referred to as "ULO").
ULO reserves the right to amend the GTC. The version of the GTC valid at the time of the order shall apply, which cannot be changed unilaterally for this order.
2. offer:
The offer is valid as long as it is visible in the shop or online shop and/or stocks last. Prices and product ranges are subject to change at any time. The images shown in adverts, brochures, the online shop, etc. and all product details are for illustrative purposes only and are non-binding. The specific information on the product packaging is authoritative.
3rd prize:
The prices are in Swiss francs, including value added tax (VAT). The price in the shop and online shop at the time of the order is decisive.
4th order:
The presentation of the products in the online shop is not a legally binding application, but a non-binding online catalogue or a non-binding invitation to customers to order the product in the online shop. ULO reserves the right to limit the delivery quantities for certain products and not to fulfil the delivery if the order is exceptionally heavy or voluminous.
An order is considered an offer to ULO to conclude a contract.
After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by ULO. An order is always final and cannot be adjusted or cancelled afterwards.
ULO is free to refuse orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded; in particular, products that cannot be delivered will not be forwarded. Products that are temporarily unavailable cannot be reserved.
5. conclusion of contract:
A contract is concluded upon receipt of the order by ULO. At this point, the customer receives an order confirmation by e-mail.
In the shop, the contract is legal by consensus.
6. delivery:
ULO has no restrictions regarding shipping areas and ships products worldwide free of charge.
For shipping within Switzerland, the delivery time is 2-14 days. For shipping abroad, the delivery time is approx. 7-20 days. There is no right to claim damages or a price reduction in the event of any delays in delivery.
For personalised products, the delivery time is increased by the time required for the production of the corresponding products. Custom products must also be accepted with a delivery delay.
There are no additional costs for shipping within Switzerland.
7. warranty:
ULO shall provide its services carefully and professionally within the scope of its operational resources and foreseeable requirements, unless ULO is prevented from doing so by circumstances for which it is not responsible.
The Buyer is aware that ULO provides its services via the Internet or by using communication networks. In particular, due to technical faults, operational disruptions and disruption or interruption of communication networks and due to a failure of IT infrastructures or other parts of the infrastructure used to provide the service, there may be temporary impairments or interruptions in the provision of services by ULO. ULO therefore gives no guarantee for the uninterrupted availability and faultlessness of its services.
There is no general right to return fault-free and correctly delivered products. The warranty is explicitly excluded for products whose intrinsic quality does not meet the customer's requirements, as well as products ordered by mistake.
8. liability:
In the event of breaches of its own contractual obligations under these GTC, ULO shall be liable to the Buyer without limitation for direct and proven damages caused by ULO through unlawful intent or gross negligence.
Liability is expressly excluded for slight negligence and for indirect or consequential damages. Consequential damages include, in particular, loss of profit, damage to reputation and loss of data as a result of temporary impairments or interruptions to the availability of ULO's services as well as due to the failure of distribution channels, transmission errors, late delivery of products, incorrect price or service information and errors in booking confirmations.
The buyer undertakes to inspect the products received within 14 days of receipt and to check the condition and completeness of the delivery. Notifications of damaged or missing products must be sent by email to info@machski.ch within these 14 days.
9. payment methods:
Payments must be made in Swiss francs.
Credit card (Visa, Mastercard), Twint and PayPal are accepted as payment methods. When paying by credit card, the amount will be debited after the order has been processed.
10. applicable court and place of jurisdiction:
The legal relationship between ULO and the Customer shall be governed by substantive Swiss law, excluding conflict of laws rules and the Vienna Sales Convention.
The place of jurisdiction for natural persons and legal entities is Solothurn in Switzerland.
11. data protection:
ULO's privacy policy and the additional provisions contained in these GTC apply to the handling of personal data of buyers. In order to purchase products via the online shop, the data protection regulations and the processing of personal data described therein must be agreed to.
12. rental of equipment: liability and ownership
All rented equipment (skis, poles, helmets, ski boots and test material) remains the property of ULO and is considered rented; the renter is fully liable for loss, theft, breakage or damage during the entire rental period and undertakes to pay the market price for the goods in this case; optionally, for an additional charge of 10 % of the total rental amount insurance can be taken out to cover the extent of liability.
13. warranty conditions
The warranty covers damage that is clearly attributable to material or manufacturing defects.
In the event of a justified warranty claim, the ski will be repaired or replaced in the Attisholz area. The ski will be replaced with a new, as-new or equivalent ski.
The warranty does not cover damage caused by
- External influences, overloading, falls, collisions or improper use
- Compression damage due to impact, transport or incorrect storage
- Theft
- Improper service, installation or maintenance
- Intensive commercial use (e.g. ski hire or racing)
- Normal wear and tear, scratches or optical surface damage
- Interventions or repairs by unauthorised third parties and improper care or storage
14. ski binding assembly & disclaimer
If you specify your ski boot sole length and body weight, we will provide your ski bindings free of charge. The binding will be tested with a new ski boot of the appropriate sole length. With worn ski boot soles, deviations may occur.
A final safety safety check according to the BFU standard is only possible with your original ski boot on an adjustment device. Liability for deviations is excluded.
